Please read these Terms and Conditions ("Terms", "Terms and Conditions") carefully before using the FastBite mobile application (the "Service") operated by FastBite ("us", "we", or "our"). Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service.

By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.

1. Accounts

When you create an account with us, you must provide us information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service. You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

2. The Service

FastBite provides a platform that connects users ("Users") with independent food businesses ("Vendors") and independent delivery contractors ("Riders"). We are not a restaurant or a food preparation entity. The Vendors are solely responsible for the preparation, quality, and safety of the food they offer. The Riders are solely responsible for the safe and timely delivery of orders.

3. Orders, Payments, and Refunds

By placing an order through the Service, you agree to pay the full price for all products, taxes, and delivery fees. All payments are processed through a third-party payment gateway. We do not store your full payment card information. Any issues with orders, including food quality or delivery problems, should be reported through the app's Help section. Refunds or credits are provided at our sole discretion and are handled on a case-by-case basis.

4. User Conduct

You agree not to use the Service to:

  • Engage in any fraudulent activity, including placing fake orders or using stolen payment information.
  • Harass, threaten, or otherwise violate the legal rights of other Users, Vendors, or Riders.
  • Attempt to gain unauthorized access to our systems or engage in any activity that disrupts, diminishes the quality of, interferes with the performance of, or impairs the functionality of the Service.

5. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of FastBite and its licensors. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of FastBite.

6. Limitation of Liability

In no event shall FastBite, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We do not warrant that the Service will be uninterrupted, secure, or error-free.

7. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease.

8. Governing Law

These Terms shall be governed and construed in accordance with the laws of our country of operation, without regard to its conflict of law provisions.

9. Changes to These Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
